Loyalty Program TOS

Welcome to the Empire Loyalty Program (the "Program"). The Program features a membership initiative enabling you to earn points by undertaking specific actions outlined herein. Empire Nutrition Inc., ("Empire," "we," or "us"), is the organizer of this Program. Your adherence to these Loyalty Program Terms constitutes your agreement to participate in the Program, and you are bound by these terms. Any implied covenants at law or in equity are expressly disclaimed. The interpretation and application of the Loyalty Program Terms rest solely with us. Upon joining the Program, you are also subject to our Terms of Use.

The Program is subject to the discretion of Empire, which reserves the right to terminate or modify the Program, including rules, benefits, conditions, Tier qualifications, or points levels, with or without notice.

ELIGIBILITY

To participate in the Program, you must be at least 18 years old and a legal resident of the United States of America, Canada, the United Kingdom, the European Union, or Australia (collectively, the "Eligible Regions"). If residing outside the Eligible Regions, you can accrue points but cannot redeem them for purchases outside these regions.

JOINING THE PROGRAM

Enrollment in the Program is open to those meeting the eligibility criteria. Sign up on our website www.myempirenutrition.com ("Website") or download the. No purchase is necessary for enrollment. Creating an account on the Website or Mobile App automatically enrolls you in the Program. One account per individual is allowed. Enrollees must provide accurate information as per the registration form, treated in accordance with our Privacy Policy. To leave the Program, delete your account by emailing info@myempirenutrition.com with the subject line "Delete my Account."

EARNING POINTS

Program members can earn Reward Points and Status Qualifying Points through various actions, such as purchasing products, redeeming loyalty codes, and referring new customers.

EXPIRATION OF POINTS

Status Qualifying Points reset to 0 at the beginning of each calendar year. Reward Points expire if an account is inactive for at least eighteen (18) months. Points are non-transferable, have no cash value, and cannot be exchanged for cash.

The Lifetime Points Earned balance includes expired Status Qualifying Points.

LOYALTY TIERS

The Program comprises four Tiers: Member, Bronze, Silver, and Gold. Advancement through Tiers is based on earning Status Qualifying Points. Only Status Qualifying Points qualify for Tier membership.

Tiers are subject to change at Empire's discretion. Tiers are attained by earning the required Status Qualifying Points in a calendar year. Upgrades resulting from product purchases may be delayed for the product's return period. Once a Tier is achieved, it is valid for the current and next calendar year ("Status Period"). Requalification requirements must be met to maintain Tier status. Failure to meet requirements leads to Tier downgrades.

REWARDS - LOYALTY TIERS

Advancement through Tiers unlocks various rewards detailed on the Website. Higher Tiers may offer exclusive merchandise, product launches, free standard shipping, and early access to launches. Rewards are subject to availability and may change without notice.

REDEEMING POINTS

Residents of Eligible Regions can redeem Reward Points for purchases on the Websit. Not all products are eligible for purchase with Reward Points.

USE OF ACCOUNT

Maintain the confidentiality of your password and account. You are solely responsible for activities under your password or account. The Program is for personal use only. Do not share your credentials. Report any unauthorized use to info@myempirenutrition.com.

You agree not to:

  • Commercially exploit your Program membership.
  • Disrupt Program operations.
  • Fraudulently obtain points or Tier status.
  • Abuse or use the Program unlawfully or for unauthorized purposes.
  • Transfer, sell, or barter points, account, Tier status, rewards, or offers.

TERMINATION; EXPIRATION; CHANGES TO THE PROGRAM

Cancel membership by emailing info@myempirenutrition.com with "Cancel My Loyalty Program Membership" in the subject line. Empire may cancel membership for ineligibility, violation of terms, deception, fraud, or abuse. Points or rewards may be revoked for errors or unauthorized actions. Program changes may occur, and significant changes affecting you will be notified.

PRIVACY

Information provided as a Program member is managed per our Privacy Policy. By joining, you consent to receive communications from Empire, its affiliates, and brands. Unsubscribe from marketing communications at any time.

DISCLAIMER AND LIMITATION OF LIABILITY

The Program is provided "as is" and "as available." To the fullest extent permitted by law, Empire disclaims all warranties. Empire is not liable for indirect, special, incidental, punitive, or consequential damages. Total cumulative liability is limited to $100.

GOVERNING LAW AND JURISDICTION

All matters are governed by the laws of Canada. Disputes are subject to the federal courts of Canada.

AGREEMENT TO ARBITRATE

Claims must be resolved through binding arbitration administered by the Canadian Arbitration Association. You waive rights to litigate claims, participate in class actions, or join consolidated claims.

WAIVER OF CLASS ACTION

Arbitration occurs on an individual basis. You waive rights to participate in class actions or representative actions.

LIMITATION ON TIME TO FILE CLAIMS

Any cause of action must be commenced within one (1) year after accrual.

MISCELLANEOUS

Each clause operates separately. If any clause is unlawful or unenforceable, remaining clauses remain in force. Failure to enforce rights does not constitute a waiver. Retain a copy of these terms.
